Ruling in Mason is welcome return to commonsense for public liability firms
MASON v Satelcom Limited is the latest in a number of recent UK Court of Appeal rulings which examine the extent to which a non-employer defendant must have "control" over work equipment to engage strict liability with the UK’s 1998 Provision and Use of Work Equipment Regulations, which deal with the duties of the employer to the employee.
