Evidence in fraudulent claims
When dealing with possible fraud, insurers need to ask themselves questions to determine whether the amount claimed by an insured would constitute deliberate fraudulent exaggeration of the claim, or whether the court would merely consider the inflated amount as a commercial offer, on which the insurer would be expected to negotiate a lower amount.
