Penalty not to be passed on
IN Safeway v Twigger [2010] the UK Court of Appeal has ruled that a corporate undertaking could not sue its former directors or employees for damages equivalent to a penalty that the Office of Fair Trading (OFT) was going to impose on Safeway for alleged breaches of competition law, report Maxine Cupitt and Simon Garrett of CMS Cameron McKenna, who acted for the appellant directors and employees in the Court of Appeal.
